When a child is born out of wedlock, “paternity,” the confirmation of the identity of the father of the child, must be made through the court system before the father has any legal rights to custody or is required to pay support. This can be done either by a notarized acknowledgement, or through formal DNA testing. Once established, the father has the same rights regarding custody, visitation and support as do married fathers.
